Course outline:

This 3 hour course aims to help attendees gain knowledge about the Mental Capacity Act 2005 and Deprivation of Liberty Safeguards and what they mean for the service user and service provider.

It will provide an overview of what mental capacity is, how to make best interest decisions and the implications of human rights and duty of care, as well as how and where to seek advice in order to make informed decisions. The course will also provide attendees with an understanding of their role and responsibility in safeguarding liberty and the correct lawful processes they need to follow where appropriate.

  • The definition of mental capacity and an overview of the Mental Capacity Act 2005
  • Relevant statutory standards and codes of practice for your role
  • Understanding your role and how to assess capacity
  • What Deprivation of Liberty is (liberty, restrictions, deprivation & detention) and the Deprivation of Liberty application process
  • The types of authorisation and assessments involved in the decision making process (e.g. assessors, IMCA’s, Attorney’s, ‘living wills’ and the Court of Protection)
  • Know how to provide individuals with information to enable them to have choice about the way they are supported
